I think PD recapturing is the only solution. We don't know if CIR will pass in 2010 or 2011. Neither do we know that if that is good or bad for legal immigration.
Guys we should work with IV to get the PD recapture.

The IV bus journey from NJ was very well planned and executed. All I had to do as a "participant" was indeed to just hop on....no fine print! On the bus and at the rally made some wonderful friends.
singhsa3, mpada and everyone who may have worked on the NJ/NY bus logistics, you have been excellent! Thank you IV core for providing this convenience.
IV handle "laborchic" who was on our NJ bus co-coordinating the minute details of to and fro journey with help from another selfless soul "amit_sp”, superbly handled stopovers, timings, ensuring that we reached rally on time and also more importantly that 'No child (read registered bus member) was left behind' and keeping driver happy etc....
Special thoughts also go to whoever came up and arranged the idea of the Gurudwara stopover during the forward journey. It was simply superb! We were able to catch up some sleep there and were fresh for the rally. The host at the the Gurudwara was most gracious. The facilities were good. We were grateful for the lovely breakfast and tea that was served.
The rally was very well organized, right to the minutest details. It was a wonderful effort from some really tired but focused and determined looking volunteer folks whom I saw scrambling around while we participants had it easy. During the rally got a good view of the Capitol Hill and other spots. The cops on motorbikes, cars and bicycles monitoring our procession looked an awesome sight. But that paled compared to the feeling of camaraderie and friendship that was overwhelming all of us folks in white IV T shirts.
Also saw faces behind IV handles, the core and other ever active ones, and found out that they were just like me, two hands two legs.... no horns or feathers. Realization then struck that what probably differentiated them from a lot of us was simply that they have reacted to the same problems you and I have in a smart, constructive and selfless manner.
This is what I could remember and share with few of you who unfortunately could not make it and a whole lot of you who did not make it. To the latter, the feeling of high I have now from having acted upon my normal demons is something I am not able to describe. I just feel it......

I just got my wife's medical done ...from the same place where I got mine.
There is not need of the xray. If you have proof of vaccination good else they will take some of your blood and do your immunization test and return the SEALED envelope after 3 days. cost $190
For TB test some times you might need to do the X-ray after the skin test if the result is 5mm or higher. These kind of tests are not suggested for pregnant women and the doctor will keep a note.

Hello everyone,
Here's my situation. H-1B for self and H-4 for wife valid through Jan 2010. However our respective visas have expired in Dec 2006. So we'll need to get restamping next time we leave the country. We intend to travel to India this Summer from May through July. Ideally we would like to get the stamping done then during our stay in India. However there is a complication (isn't there ever) since my wife has an employer willing to sponsor her H-1B (starting in Oct 2008). I heard from the gurus here that this will be a COS from H-4 to H-1B and it is strongly recommended not to travel when a COS is pending. I think my options are as follows :
1. Get H-4 visa stamping in India in June while there. Assuming we do a premium processing for my wife's H-1B in April and travel to India after the decision is made (say by May), will there be any problems getting the H-4 visa stamping for my wife in India since we want to return in July before her H-1B starts in Oct?
2. The other option is to get a new H-4 stamping done before applying for the COS in April. This will be either done in Canada or Mexico I guess.
3. Another option is to straight away get the H-1b stamping for my wife in India instead of H-4 but that will cause her to wait in India through October which we would like to avoid.
Personally, we would like to do the first option, just get the H-4 restamping done in June and get back to US by July. But since she'll probably have an active H-1B starting in October, wondering if that will cause any issues when we go for the H-4 stamping.

Second question is, In my old passport there are 2 valid US visas, 10 Yr B1 and 3 yr H1. How do I get them on to new passport?
You don't have to ( you cannot) transfer visas to the new passport. You will have to carry both old and new passport together all the time. POE officers/Indian immigration officers will use the old passport to get all your visa and travel information.

For Indians we had vaccination in India at our childhood. Due to this some will get positive results in the skin test. Then doctor is going to recommends for chest x-ray. Some of the doctor's are going to overlook this. Because the medical report is a sealed cover we don�t know what number he written in the medical examination form. You can ask the doctor.
And one more thing is for skin test we have wait couple of days.
From my experience I recommend others to go for x-ray. In my case my immigration doctor, he written 5mm as reaction for skin test. USCIS sent RFE on this to go for x-ray.
I gone for x-ray and answered the RFE immediately.
A chest x-ray is required only if the reaction to the TB skin test is 5mm or greater.

I renewed my passport under tatkal this month. I mailed application overnight on Thursday and Monday got a call from Houston that Money Order attached is less 50 than actual. I mailed balance next day overnight, it reached them on Wednesday and got my passport after 4 business days.

Anyway just by checking most of this consulting firms businesses they will be able to uncover all the fraud.
It's very unethical to make you lie on your resume and then try to market you to an employer with fake experience, also nobody has responded to my comment. Real Companies like PWC, IBM pay you while you're on bench, while this indian consulting companies break the law by not doing that.

Otherwise, all you get is a grace period of 2 paychecks to prove the worth of employment. I'm telling you this truth with a verifiable employment history of more than 8 years in USA.
My friend, all that matters is how much revenue one can generate. Just doesn't matter whether you are working for Big5 or small and tiny consulting companies.

I believe that as soon as you file under section 245k, your spouse will be eligible for EAD, AP.
Also, I have heard that 245k is straightforward and will be granted quickly- meaning your spouse will be granted gc in a couple months.

I know there are plenty of suggestions flying around and here is my 2 cent, it may or may not make too much sense, but here it is.
We can rant about the difficulties of not getting a GC, make emotional pleas of our struggles all day, but nothing talks better than money. In the current scenario nothing will grab more attention if you can show how we contribute to the US govt and the US economy in monetary terms. Nothing else will get the attention of these lawmakers like money can. ;-)
Can we put out some numbers for the lawmakers, in terms of our contribution to federal & state taxes, social security, property taxes and overall economy by way of our purchasing power home, cars, appliances, vacations, etc (all the amount that you spend in the US) and multiply these numbers by the number of folks waiting to get GC or who have the GCs. I am sure when you add all this up it will be a significant number, which is bound to catch some attention. Assuming the majority of us make more than the average American, all these figures will definitely standout.
Also propose a one time fee of $10,000 to apply for GC right away. I am willing to pay this fee if USCIS can grant me a GC or provide us a way to stay and work legally in this country with no tie in to the employer. This could be a significant amount of revenue, especially when all lawmakers are looking to reduce the deficit and raise some income. As it is they are regularly increasing the visa fees to pay for some bill to the other like the 9/11 workers healthcare bill, etc. If a 100,000 folks(not sure how many are there in total) like us cough up $10,000 that could equal 1 billion. May seem small amount compare to the US deficit, but when you add up our total contribution it is significant. This may be totally outlandish, but I think something on this line is worth talking about. Like I said, nothing talks better than money.
Not sure if there have been other similar ideas, but if we can compile a few pages of such information with numbers, graphs, comparative charts etc and hand them out to the lawmakers it may help.
Comments and feedback welcome. May be this is totally a dumb idea, but if the admins think it makes sense willing to discuss and prepare something. Also this post is not meant to begin a debate or to distract us from our goal but just some thoughts.

This is the most insane reason i can think of.GC itself is a distant dream leave alone citizenship...and Aging parents...do you really know if they want to reside in this country here permenantly.3-4 months are over and they just want to escape from here coz they just dont like.And some mean children bring their parents to do nursery/take care of their children as free home nannies with paid airfare,boarding and lodging with food.
That is not the case with me. My kid goes to day care and I always keep it that way. As far as them being happy here is concerned then yes I would agree they won't have much social interaction here as they have right now living in small town in India. But for me, as I am sure with many others the choice is not simple. Either I let them live alone where I am not there to take care of them or have them live with us here and they would rather choose the latter.
Anyways, I think we should not take this thread into another direction.
