I don't know much about the process...but can't you just scrap your old labor...file with PERM (15 day preperation time, 1 mth Ads, 1 mth waiting period -- puts you in sept 1st), Labor cleared in 3 weeks (sep 21st) and then file 140 & 485 together. Might cost you like 10,000, but in my books its totaly worth it, if you & your wife get an ead even 6 mths earlier.
Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

There is a laundry list of things which are all good. Unfortunately I dont see anything realted to the ability to file 485 when priority date is not current.
I guess it does not matter since this never passed. I can only hope that this does not become a trend and 485 measure is forgotten

Appended to the Minimum wage bill was SA187 which amends SA112 sponsored by John Kerry and consponsored by Sununu, Snowe, Landrieu and Lieberman.
Senate Amendment SA 187 seems to have passed with unanimous consent. This is what it apparently contains among a lot of other stuff... Please correct me if I am wrong.

I have received approval on April 04 and today I have received GCs for all my family but not for one of my daughters. I checked USCIS and I just realized her application is still pending. She just turned 14 on March and she only did FP 2. Do you think she has to do again FP or they just left her behind......
Same story here. They will send RFE for biometrics for her. Expect it within a month, if you do not get it in a month, take Infopass/call and ask for biometrics appointment. My daughter's I-485 was approved next day after FP.

Hi Guys,
I know some of you may have concerns about the distances at the three events we have picked so far. If you are new to walking/running, this would be a really good opportunity for you to start training with the support of Team IV members as well as two personal trainers who are going to give us support and feedback on a weekly basis. These trainers are doing this for Team IV for free, to help our Team. So we should really take advantage of such a bonus feature.
Starting your walking/running goals by attempting a 5K is a very good target to aim for. A 5K is 3.12 miles and you can walk this distance at a moderate pace, no not race walking, just a moderate pace in 45 mins. So this is quite a do-able distance. Also, you can train to jog or run the 5K in as little as a 6 or 8 weeks. Once you sign up with Team IV, we can provide you with more guidance. We have got the support of a couple of major names in the walking/running field.:)
So come on, join Team IV and lets get this ball running, or jogging, defintely walking.

once USCIS gets a visa number from DOS for a "pre-adjudicated" app, it has to complete the approval and assign the visa number within 7 days, if not the visa number has to be returned back to DOS.

People who are in the EB3 India que waiting for the Visa numbers availablity for a decade, by default fall into EB2 category with out any argument. If they working for any indian service based companies like CTS, Infosys, TCS then they easily would be qualified for EB1 with the project manager designation. The law makers at the time of writing/passing the current EB immigration rules might not have been expected this kind of backlogs/ scenarios for few countries.
On top of it, EB3 India and China together got only 4k visas during 2008-2009. They together still supposed to get 2.5k visas during 2008-2009. Its been found out by vbkris77 and . Vbkris77 has already put this point in his questions to the concerned administration.

Vow, what are you suggesting? Everybody should drop out? People like Einstein, Bill Gates etc are one in a multi-million chance, 99.9% dropouts don't fall into that category. There is a reason people from elite institutes are respected/sought after. Agreed, there may be some totally incompetent inspite of being from a Tier1 school, but whats the percentage of such people? 0.01 %?

Hi Folks,
My PD is current but my lawyer is saying that I CANNOT file I-485.
Reason:
My labor cert / EB2 was originated in Illinois and then amended for Virginia by G-28.
Since my labor cert approval, i moved to Califonia - same job, same company.
Now my lawyer is saying that I need to go back to Virginia so i can apply for I-485.
Question:
1. Do i have to go back to the same state/location at I-485 filing stage where my Labor was originally approved?
2. Doesnot Green Card is for a future job?
3. Can i file I-485 while I am in California and my labor was approved for VA?
Please advise - thanks

Instead of writing a letter, why not start with a phone call. Find out a bit about the staff ahead of time (Google, Linkedin, etc.) and then call the person that is most likely to be helpful. Then ask for a meeting.

Those who filed under EB2 think, EB2 PD moves to 2005/2006. These predictions are mostly prejudicial. USCIS may have some idea after entering all June/July/Aug applications, that is if they can find someone who can add :D.

if you look at the data at carefully, you won't get that conclusion--india EB2 is not the only victim!
Perm is not based on nationality. All people with their perm audit are the victim of slowing Atlanta!
