Like it or not In legal language you become more so called bright in EB2. If you apply in EB1 you upgrade your so called brightness. It does not matter in reality who you are. But as far as law goes for EB1, EB2 and EB3 etc it prioritizes based on qualifications needed for performing the job function. Our employers and lawyers decide on those requirements. Have you questioned those requirements?

I am ROW-3, Applied for I-485 and EAD cards for my self and my family members. RD 06/19/07, ND 07/19/07. Received EAD cards, finished finger prints and waiting for name check.
I have another family petition (theu my Dad) and my periorty date became current this month. I do not know what to do. To go ahead and apply for GC using may father's petition or to waite untile I hear from INS regarding the work petition.
The cost will be about 4,000 $ and I am afraid that I will be stuck in the name check againe. I was told that I can only have one pending GC petition at all times. The advantage of the family based petition is to be able to work for any employer, no restrictions at all.
Any ideas, please advise.

Soft lud on : 7/20/2008 and found via Infopass that it was when they received fingerprinting from the local office to TSC.
Still waiting while the previous EAD is about to expire on August 15th...:mad:

Thomas does say about the amendment. It was included in minimum wage bill that has passed in senate.
Even this amendment S. Amd 187 was agreed to in senate. So I believe if the minimum wage billed has been passed then same goes with the amendments too. So we can still hope and not that this was hoax.

I wonder if such a reaction is warranted considering that there's official news from USCIS at this stage. I would not support the litigation.
If it does become official I guess we have to rush to file the suit, who knows may be they will have priority dates for the law suits too.

I don�t know if this was just a tit for tat amendment (maybe sessions introduced a anti-immigration amendment and Kerry in retaliation introduced his amendment)
Also was this just something that Kerry threw out of his pocket. Or is this a precursor of things to come?

No news on EAD,
65 days and counting.
Got RFE on e-filed AP for my wife. They probably lost photos and asked for new set. Just shipped the reply and photos back to TSC.
Hope that triggers something.
Last time, I got couple of soft LUDs on 07/24; 07/25; 07/27 on all our EADs and APs. Wife's AP has hard LUD 08/05 (when they issued RFE) and soft LUD 08/06 (when RFE was mailed).
65 days and counting.

Tons of thanks for your time and this letter. Though most of the case are pending with Atlanta, there are few people struck with chicago as well. But the number is very small compared to atlanta. This template sounds very good to me, I will post the same at IV and let you know the feed back. Also I will direct the folks struck in chicago to you, they can hire you if they want you to represent them or I will ask them how do they want to proceed.
If we give the case number and employer name, would there be any impact/side effect ?

All of the Chicago cases have been transferred to Atlanta. If the Chicago guys want to talk to me, I�m happy to do so. They don�t have to hire me if all they want is information. As for putting names and case numbers, without that information, they won�t take the letter seriously. Also, I think that this will get the DOL to move on those cases. Almost every time I have made a specific complaint, they have responded by resolving the case right away in order to make the whole thing go away. It wouldn�t surprise me to see the same thing here.

On USCIS status, it says.." On October 11, 2007, we received this I485..." .
Processing time for TSC is Aug07.. Does this mean my case will not processed now?
There is no telling, there are already some approvals where the ND is in OCT and TSC approved those. Online it always shows ND as your RD. Be Hopeful.

my wife filed on may 29th, soft lud on june 6th and fp done on june 21st. no updates/luds after the one on june 6th.
my wife called them last friday and opened a SR.. we'll see if that helps.. i think we will go ahead and schedule infopass as well..

new one is lower case i-765instr.pdf and the older one is upper case I-765instr.pdf
check the revision date at the bottom, they are different. also check the 'where to file' section on page 8.

A key sticking point for some conservative House Republicans is the president's plan for resolving the status of millions of illegal immigrants in this country.
The bill approved by the Senate would allow illegal immigrants who have been in the country at least five years a way to become citizens if they pay fines and back taxes and learn English; the House plan would make illegal presence in this country a felony.
The president has endorsed the Senate approach and Tuesday indicated he does not regard such an approach as "amnesty" because illegal immigrants would have to get behind legal immigrants in line for citizenship. He added: "If Congress is worried about the number of people getting in, they can decrease the number of green cards. If you want a longer line for people, issue fewer green cards."
Despite the president's statement, "most Americans" consider his plan to be amnesty, said Rep. Mike Pence, R-Ind., a leading conservative. "There's just no support at home or in my heart."
Before the speech, Bush watched as agents in training staged various scenes depicting what it is like to work on the border. He later flew to Laredo, Texas, to visit officials at a regional headquarters for the Border Patrol. He watched television screens monitoring different points on the border.

Anything to be written in pencil on the back of photos?

Name and A# to be written on back of the photos. I always use Fine tip permanent pen than pencil.
