Hi,
My 485 petition is with NSC. I opened an SR last month and got a rather uninformative response today. It does not tell me if my petition has been pre-approved or has even cleared the background check.

To begin with, Slumdogs writing style is really refreshing and one day he writes a book, I may be inclined to buy it :)
But he seems to be really upset about the "Non GC house buying" group bashing ..I think the bashing is both ways. Many a time these self proclaimed SMART home owners feel that they know too much and ridicule people who haven't bought a house yet.
And the big reason people who bought homes give is they are giving their family and children a good quality of life ..And people who dont buy homes are SELFISH A** who don't care about their family and only care about saving Money.
I seriously don't understand this argument. For one i don't own a home yet. I definitely want to one day. But currently i rent a beautiful 3 bed town home with my own backyard which connects to a beautiful park. the yard is maintained by the community .. Also all the maintenance is taken care off. I am totally happy where i live..The day i feel bored i will move into a better place. So for me when i buy a house it should be much better than where i stay currently in every sense. My dream home should be truly luxurious in every sense, And i should feel that my standard of living has gone up after i buy a home. As of today my dream home in a good location is not affordable for me. So till the affordability criteria is not met, I plan to rent a nice home.
So to conclude please do not equate quality of life to buying a house. Its the people who live inside, who make a house a "HOME".

I just don't see why you jumped all over the guy. The lawyer told him something that he thought was horrible - and rightly so, based on the info provided to him by the lawyer. So he posted that, in hopes to inform his fellow members about this situation, and probably he was hoping someone would confirm or disprove that. Instead everybody jumped all over the guy. We may all be stressed out with all this CIR / July bulletin roller coaster, but let's not too crazy and devour one of our own. He ain't the one who caused you the pain in the first place.

EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.
This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1. :mad:

Even I have started to hear quite a few cases now that indian IT PM or manager are being labelled as multi-national executives. If this is not stopped then any relief from spillover, you can just forget about it. I have heard lot of cases now like this and we need to do something about it. Only genuine candidates should be able to apply in this category.

Trust me, in the past we knew of some guys who tried to distract the forum attention with proposals of doing somethings in the lines as you have said. Their goal is to distract and divert attention.
First, I am not promising to solve anything. I am just saying that I will bring up the issues when I have my meeting. If this thread is a distraction, then feel free to ignore it.

In my opinion ,this is what is most important. What good it is to live like kings for few years.

I do not have a GC which means my entry in US is not guaranteed the next time I visit my home country. Period. The risk is simply not worth taking. Congrats to those for whom it worked out. You are far and few people.
I recently had the taste of this experience when my wife got 221(g) at Mumbai Consulate and had to enter using AP. Imagine if she did not have an AP and if we had a home what would we do?
Today in this scenario we can atleast sell everything we have and cash out of US. The stakes and dependency gets higher if we own a house. I would advise anyone against "investing" money in US when you dont have a GC.
I bought a property in India in the meantime and the value has doubled and I am pretty happy about it.

You can send 2 x 2 photo.. they will cut and make it like a 3.5cm x 3.5cm Or you can use epassportphoto dot com to get yourself a 3.5cm x 3.5cm passport photos for less.

My wife is entered into US on H4 in 2004 June and we applied H1 for her and got the H1 in 2005 for validity till 2008. we went to vancouver for stamping and the consulated given us 226(g) and asked us to go to india for stamping. From vancouver we entered into US by showing my h1 and she entered into US on H4. In 2007 - I applied my H1 renewal and at the same time applied my wife H4 and got the H1 and H4 without any problem.
My question is can we renewal my wife H1 ? I mean can she get new H1 or renewal H1 ? because my wife H1 validity is till sep 2008.
please suggeset someone and help me out.

I called and enquired abt my case. I told I was beyond normal processing time. They gave me some service request no... and told me I will receive an email within 30 days. What does this mean!
This means that if your receive date at the center (which is close ND) is not before the published processing date, they don't want to entertain your complaint. Note that published dates is, up to which they believe they have handled all cases. It does not mean they have not handled, or are not allowed to handle, any case received after the published processing dates. But they don't want to entertain any enquiries on those cases. SR simply means a standard reply within 30 days, if your date is actually outside the published dates.
