It is explicitly mentioned that quota is over for "year".
I always thought that DOS issues the visas to USCIS and that this is done quarterly. If this is the case, how can USCIS say that all visas are used up for this fiscal year when we are only in the 3rd quarter? Would they not be obligated to wait for new visa numbers in the 4th quarter? How can USCIS allocate more visas than they actually have. This is strange!

Ask your employer keep everything ready backlogs will be cleared by sep 30, hope you get your LC before that and you can apply for 140 & 485 concurrent. I know it is unfair, we can't help but act smart.

We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

Hi All,
Regarding my I-485 appln. status - I do remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.

After doing a conference call this weekend, we think we should close this thread. There are not enough people for us to consider a large public campaign. However this does not mean IV is not and will not be working on this fix. This fix has been a very important fix for IV for several years and we have it in our legislative and admin fixes agenda. Those that came for the recent advocacy day event know that it is a key provision that relates to our quality of life concern. Every other legislative fix we are trying is also tied to I485 filing. We advocated for this fix in our just concluded advocacy days and will continue to do so in every opportunity we get. The purpose of this thread was misunderstood and people thought IV will only work on this fix if there are 5000 votes.
We were at the time of starting this thread considering a possibility of launching a campaign like http://immigrationvoice.org/forum/forum16-iv-agenda-and-legislative-updates/17157-deadline-march-1st-target-25000-letters-can-we-make-it-happen.html when the timing was right.

You need a big organization like IV behind it where we take all these letters with us for the meeting. We also need a strong ongoing advocacy effort in DC though lobbying.
Another point to be noted for all people wanting to file I485 is not to think narrowly about your own I485 application. It will be counter productive to your own cause and the overall effort we are trying to do. This also applies to people who have filed I485 and do not wish others to be able to file I485 because their own application might be delayed or some other reasons ( Here is one past example . We are going to adopt a zero tolerance policy to such people when we come across. However, since these people have some influence, I also wanted to discuss with them some of the more important issues facing skilled immigrants. I will mention the idea of meeting with more people in the future. I think it is important for them to be more in touch with those who are affected by immigration policies. My sense is that many of them don't understand the issues very well.

The situation is the same. In my case and of course in most of others too, what he/she said is correct. Waiting for Eb3 to cross 2001 has become a difficult thing. If I started an EB2 app rather than hoping positively, I would have finished my wait for GC.
Ever since retrogression started the dates have not crossed 2001. 245i or not, the backlog is a fact. Sad part, when there is action items from IV, trying to talk to my state members, I have realized and been told that IV does not cater to EB3 anymore. It is disheartening how much ever I try to explain, occasional members look at IV threads like EB2-EB3 predictions and say there is no hope for EB3 and also IV has no answer to it.
I tried my part...too bad I was not able to participate in the IV advocacy day due to family emergency. anyway, let us hope IV's persistence yields us the results. My heart goes for a lot of EB3s who may automatically qualify for EB2 just due to their experience.

You are hearing utter nonsense from your friends. They have no inclination to find out the truth or wish to take part in the action item. Such armchair strategy folks are the reason we are all suffering in EB3 I. If these folks joined this effort and worked hard to fix it, we would have made lot more progress. Despite being highly educated, some people fall prey to divisive posts and opinions on the forums without checking the facts.
People who had come to the DC advocacy day this month know what we do and that our focus is solving EB retrogression completely. We do not talk about EB2 , EB3 categories. We talk about the overall retrogression in EB visas.
The biggest damage and threat to this effort is not from anti-immigrants or other interest groups but from people of our own community who spread lies, pursue personal agenda and grudges, talk against this effort and cause damage to this community effort. They forget that this damages their own cause. Have you seen divisive posts, or anti-organization posts on the forums of anti-immigrants? Just think about it.
After leading this effort for more than 4 years I have come to a realization that we as a community are the reason of our own failure and the reason for our own successes. There is nobody else to be blamed. If we have to blame someone for this broken system, it is ourselves for not being able to get together and fix it.

In essence, this is another form of discrimination so that people like you and others could fight on forum like these ;-).
By your logic, why even require a degree for an H-1B visa? Why not allow janitors, waiters, domestic help, etc. to apply for H-1B visas?
You are missing the most critical part. The H-1B visa is a "skilled worker" program. Why should the U.S. not be able to differentiate and prioritize based on level of skill? The level of skill may be hard to measure, but accredited degrees are certainly the quickest and most objective way of doing so.

Is this something normal or i am about to be greened?

I have opened a SR on 8/3/2010 and my case (including my wife) approved today i.e 8/6/2010.

Please avoid posting any name of any consulting company on our forum either advertising their services or websites to find such companies. This is not a job board or area to list employers if you are unhappy with them. We have been deleting posts by members naming companies or websites to find consulting jobs. Can you pls elaborate on why your are suggesting to stay away from day trading? wht kind of exp hv you had with day trading? I want to know the pros and cons and hear the experience from ppl with hands on / who hv tried day trading in the US and found it too risky. Thanks!
As said earlier its addictive(substitue the word 'gambling'), heavy amount of risk involved , limits are high as well and one has to be careful while filing the taxes apart from all the risks associated with the regular stock trading. It aint bad if you can identify the trend and want to make some quick bucks.
Because of the volatility in the markets right now, day trading is thot to be beneficial at this time rather than holding.
But if you are new to trading and have some monies sitting in your checking a/c , I would advise you to put that in ETF's , as this timing is great for entry, as its the bottom of the barrell.
