I is only based on a law. In the past CIS used the law to implement one set of policy (horizontal spill over). Since the middle of 2008 CIS is using the same exact set of laws to implement a different set of policy (vertical spill over).
They can interpret the law how the language was used in the legislation as well as what congress intended to do. Any way, before 2000, INA clearly enforce the veritcal spill over in EB catagories. That is exactly my point that Perm Audit is not focused on Nationality, Field or EB category. If most people are from India, China, Philippines then automatically most audit cases are going to be from these countries.

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). I renewed my passport last year. Initially I sent it to Houston consulate but I had sent with a NY address. So they sent everything back saying I have to approach NY consulate. But then again I sent to Houston with a Texas address. This time they processed it and sent my passport within 15 days. I think I also called them over the phone, and they patiently told me how long it might take to renew the passport.

Well, here we are: the water is IV's target...the pebbles are the contributions ($200, great, but $20, still good!!) from a large number of members. It's impossible to justify why one can not contribute $200 when the core members and some others like you & anurakt have given so much more. I believe it is equally important to encourage as many members to contribute as much they can.
No contribution is too small if it is actually made. An ounce of action is better than a pound of intention!
Some legislative action is expected in Feb. Money will be needed immediately. I don't think $20/month is the answer.

You should pay a total of $200 immediately if you have paid less then $200.

It is obvious that DOL backlog center is processing cases with utter disregard to FIFO procedures. Some people with priority dates in 2004 or 2005 have obtained their labor certifications, but some people with priority dates in 2001 or 2002 still do not know what is happening to their cases. If we file lawsuit against DOL on their inability to maintain FIFO procedures, what are the chances of success? Their inability to maintain FIFO procedures has brought great misery in lives of the people who stood in line for so many years so patiently.
Just like the Right to Information act that was passed in India recently, the US also has the "Freedom of Information Act". I think you can ask for documentation from the agency to get information such why its taking so long for your application.

That's simply incorrect. Since EB-2 India was held up at Jan 2003 from Oct 2005 to June 2007, most EB-2 filers from 2003 and 2004 are still very much out there and waiting. You have to remember that most 2003/04 EB-2 filers from California/NY/NJ/WA were rotting in BEC. High demand states have not approved any labors with 2003-2004 PD's before 2005 when BEC started to approve them. But this was too late as dates were already retrogressed, thus for almost 2 years there was build up for 2003/04 EB-2 cases. I know a lot of them personally.
The only exception to this might be: There were very few cases filed in EB-2 during 2003 and 2004, but that is hard to believe.

I think best startegy is to wait for future bulletins. I have already stated my belief and that is with confidence. Does that mean I am trying to say "This will be the only pattern". In case of USCIS nobody can tell that.

Hello all,
I live in Los Angeles and sent my application on 11/26/07 to CGI SF and received a call on 11/27/07 notifying me that it would take approximately 30 days to renew my passport since it has been over 3 years since it expired. Apparently they need to contact authorities in India to do additional background checking.
Yes, I admit that it is my fault for not checking my passport prior to making travel plans and not renewing in time. However, with the hope that the "emergency/tatkal" scheme would work in getting my passport renewed before my departure date of 12/15/07, I did include the extra $90 for the "emergency/tatkal" scheme. Though I sent the extra money, as I mentioned above, they informed me that they would not be able to expedite my passport renewal.
They informed me that the "emergency/tatkal" process is for grave emergencies only. Fortunately (or unfortunately) I don't have a close family member on their death-bed and I did not want to lie on the application.
In any case, they have sent my application back and it seems that I am out-of-luck and will probably have to cancel my trip.
However, I do have questions for people who have received renewed passports in less than 2 weeks from various CGI locations:
1. Did you apply to the CGI in the appropriate jurisdiction?
2. How long had it been since your passports had expired?
3. Did you know people who worked at the CGI or just got lucky?

I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,
For 2nd Case should we file by mail, providing certain reason with the application?
I personally know someone who got BPC labor approved in Eb3, then applied for Eb2 for same position , only difference was his first company was bought by another company and he applied Perm with 2nd company.

What nonsense is this.
Isn't this supposed to be a public forum that people can join and share updates. There is no disclaimer that one needs to donate to participate in discussions on this forum.
If donations are mandatory - this would have been a paid only website and access to all should have been restricted. I bet the participation and visibility of a useful site like this would be detrimental in this case.
I said contribution, not donation. Money is not the only way to contribute.
last week I spent 4 dollars in sending letters abt EB1 fraud - I did not spend much money but contributed; that's what i'm looking for.
