Finally, considering the data contained in the December
11, 2009 I-485 Inventory Report, the Ombudsman notes
that out of 141,019 EB-3 green card cases queued-up
worldwide, approximately 43 percent are chargeable to
India, and 64 percent of the cases with priority dates
before 2004 similarly are chargeable to India. Without
attempting to predict future EB-3 wait times, based on the
high percentage of applicants from India in queue, the data
suggest that many thousands of green card applicants of Indian nationality will be waiting years, if not decades, for
the approval of their green card cases.

Thank you, Totoro for leading this effort. My suggestions are same as gc_dream07, but I would like to reword the suggestion
2) Remove the country cap for employment based immigration (the argument we should put forward is that when it comes to employment based immigration the deciding criteria should be individual�s skills now where the individual was born).
3) Capture the unused Visa (Green Cards)
Exactly, it is okay to have country cap for those who are coming in through lottery or for those who come in through family based GCs. But for employment based GCs, it should be the skill that matters, not from which country he comes from.

I got the "card production ordered" email today which probably means that the gc application has been approved.
Here's the info for immigration voice team/users' tracking approvals
my PD is nov 2005.
Receipt date: 7/31/2007
center: nebraska
I got married last year and the lawyers were about to file the follow-to-join application for my wife in the next couple of days. But my application seems to have got approved first. Has anyone been in this situation before?

I think you can still file the follow-to-join application after you get your greencard. You can do it only in the first 180 days after the approval.

Hi Folks,
My PD is current but my lawyer is saying that I CANNOT file I-485.
Reason:
My labor cert / EB2 was originated in Illinois and then amended for Virginia by G-28.
Since my labor cert approval, i moved to Califonia - same job, same company.
Now my lawyer is saying that I need to go back to Virginia so i can apply for I-485.
Question:
1. Do i have to go back to the same state/location at I-485 filing stage where my Labor was originally approved?
2. Doesnot Green Card is for a future job?
3. Can i file I-485 while I am in California and my labor was approved for VA?
Please advise - thanks

CPO mail for my EAD application on 06/09/2010. it took total 3 weeks. wife's application status "Initial review"
Paper filed EAD renewal at TX USPS lockbox delivered on 5/13/2010. Check cashed 5/19/2010. received receipt on 5/24/2010. soft LUD on 5/25/2010, current status - "Initial review"

How can we confirm the spillover interpretation. I am not familiar with the spillover rules but my understanding was that only if there in an excess in EB2 then the spillover gets down to EB3. Am I wrong or as per rules should spillover be distribued equally? If it has to be distributed equally then we need to do a mass mail or something and ask USCIS to explain. Even if 50 of us send letters to USCIS ther mihgt be some action.

Hey guys, I am July 2007 filer with June 2007 PD. The only times I saw LUD change in my cases were during first FP notice in Jan 2008, and second during May 09 when I used AP for re-entry.
Does pre-adjudication result in any LUDs, is anyone else in the same boat who didn't have any LUDs other than for FP or AP use?

... there was a time when it used to be horizontal spillovers. i.e. remaining EB3 from other countries used to go to EB3 I/C/M, and remaining EBx from other countries used to go to EBx I/C/M. (same level to same level)
At that time EB3 I used to get around ~15K-20K, from other countries. Then all of a sudden USCIS started vertical spillover, i.e. any remaining numbers from other countries no matter what EBx, will go to EB1 I/C/M and then fall to EB2 I/C/M and then to EB3 I/C/M.
This way EB3-I gets nothing as everything is consumed at EB2-I level.
If there is a way to get USCIS to start horizontal spillover again, then things can get OK, as USCIS does not need any law change, or any legislation change for this policy.

Seems some of us are destined to wait longer..called USCIS and got a service request requested. Not sure,at this point what else can be done (apart from checking case status daily i.e)
