Also, lot of EB1 guys working through consulting companies - negotiate there Green Card to be filed as EB1 before joining them.
And Consulting companies can show anything they want..any hierarchy/structure etc.
On the other hand, actual PHD does have lot of knowledge , publishing paper is daunting task which needs lot of research and originality.
A lot of Desi Consulting Companies do these kinds of things. They can cook up any resume and any requirement.
Real PHD guys who worked their asses off day and night in trying to publish some worth while papers are not getting consideration for EB1 and these DCC guys with a bachelors in any discipline and 5-7yrs experience can become Multi-national executives and fall under EB1.
Nothing helps us legally working people with US Masters Degrees who have been living as law abiding citizens for years.
One of my friends who did Bachelors with me in India came to US on h1B and actually bought his EB2 Labor back in 2005 through a DCC and now has a GC. He never even told me that he did that. He told me recently after he got his GC.

Please call all of them. They asked me whether I was from district or particular organization, and I said I am not from the district but I am a member of Immigration Voice and they have taken down my message.
the person who took the phone asked where are you calling from? I think they care for calls only from the rep's distrcit? Also would verbal messages to any staff be sufficent? no fax?

I tried calling NSC, after I punch in my receipt#, it says accessing your record but then it gives me message "Due to temporary problem with our system, we can't access the information". I tried calling again 10 minutes later and got the same message. Anybody else facing same issue?
Yep...I got the same message the first time. After disconnecting and trying again, I was able to get my case status info. Try calling again after sometime.

I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.
Please help.

Hi,
I have an California EB2 RIR LC app pending with backlog center with PD of March 2005. My 6 years of H1B are over and am an Indian citizen.
Is it a good idea to convert this application to PERM - my company lawyers say that there is a risk in that if the application is rejected, there is no back-up + it can take upto 8 months to process under PERM due to the conversion.

It is very true that it might take a long time for the conversion cases to get approved. Mine took 6 months with audit. Your PERM application must be identical (not similar, it should be 100% identical) to your RIR case. It was quick and painless....called all offices in 10 mins and most took the message. They are going to start getting a lil curt as it seems they are receiving a lot of calls, however our purpose is to FLOOD them with calls so keep calling guys!!!:p

why would EB2 retrogress to before 2003? It was at 2003 for a long time (8 months?). The only people still with PD of EB2 2002 are the ones just getting out of BEC, there cant be too many of them...
Yes, I agree. For the same reason, there may not be much EB3 2001 and 2002 cases left. Hence Eb3 would move to 2003 soon.

By grace of Almighty, finally my Inbox received the email from USCIS that I was eagerly waiting for.
Just few minutes back, I received the Email from USCIS for myself, my wife and daughter saying "Current Status: Notice mailed welcoming the new permanent resident".
It's a long journey started in August 1997 with landing in Washington Dulles Airport. Got a chance to start the GC process by filing Labor in 2001. The labor approval didn't come until 2007.
In 2004 had to take a transfer to different company which caused me to start the Labor again in Nov 2004. Lost the valuable 3 years of PD date.
Finally the approval for 2nd labor came just right before 2007 July Fiasco. Luckily I had my attorney filed my application on July 2nd itself. And Rest you know the story.
All throughout I was on H1B, on permanent employment and never out of status. Never had any problem with Immigration process except for the GC delay. In any way it was an interesting journey, making new friends, had the chance to live in SFO, LA, New Jersey, Virginia and currently in Maryland.
Many thanks to IV and its members for providing the wonderful platform for sharing and collaborating for common cause.

All she said was that I will be hearing from them within 60 days. When I tried to ask more questions she said "Sir, I told you 60 days, consider that a very good answer". She would not say any more. Maybe she saw that it was already approved but probably they are not allowed to tell that to us over the phone till we get the approval email and said that in a cryptic way.

When you called TSC prior to your GC approval, what did the IO at TSC tell you?
I'm asking because I know your RD was June 2007, when I called TSC today they told me that they have not got to my I-485 application because they are currently working on I-485 applications with RDs of April 2007 and my RD is June 2007 like yours.

2)If my I 485 is approved before I file my spouse I 485, is it Okay to file I 485 for the spouse as normal case ?
No you cannot, if your case gets approved, your wife will loose H4 status.
What are the other options for this ?. I will make sure I am filing I 485 1st week of June, but you never know since my 485 is pending for long time, there may be a chance it gets approved fast, in that case what other options are there to file derivate/spouse case. ?

People from EB2 India June are getting approval left and right with in 3 days of months which is good sign. What does that mean ? DOS prediction for porting is not as high as they thought.
If porting was high then people from EB3 who ported should get more and more approval than people who are in EB2. We will not see any movement in June may be week or two but in July I think we will reach end of 2006. Aug and Sep is DOS's call.

EB1 is the brightest not in all ways. If you are a manger in outsourcing company and in one more country u still qualify for EB1. It does not take long to become a manager in outsourcing companys. So how u can break the law or tweak around it works. I know people who were on bench life long in consulting companies in EB2 got GCs.

Those of you that are in the fence on whether to support IV or not, see below, our adversaries are not sitting on the fence, they are mobilized and will be in DC the same week as us advocating for the exact opposite of what we want. Please consider this and support IV.

I had submitted my entry visa application form to Travisa ,Houston on May 24th.
I honestly dont know why it took them 5 days to submit it to the consulate. they submitted it on May 28th.
I tried several times to contact the consulate. Everyday I am on hold for atleast 30 -45 min and the phone automatically gets cut.
When I contacted Travisa last week , the lady told me it would take another 5 days.
Today, when I spoke to the agent, she was so rude and told me that if the visa was getting delayed, I should as well cancel my trip. she also indicated that it may take another week for it to process.
I wish somebody talk to these travisa agents at Houston and get things done faster.
One more thing, whenever I call they all they put me on hold for 10 minutes before they even answer.
If these agents had submitted my application on the same day it was received or atleast the next day, perhaps my processing time wouldn't have been delayed so much.

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them . I would suggest to go ahead and take infopass appointment as the chances are that you might not get appointment right away, if you have a choice on selecting dates, take one after 5 days, so you have passed 90th day.

If you are lucky and get your card prod. email , you can cancel infopass anytime.
