    Hi,
    I applied for H1 and H4 for my Family in 2005. I was working on L visa that time. Our H1 and h4 got approved in October 2005 but we were in India that time. We came to US again on L Visa in 2006.
    After coming on L visa my new employer applied for my H1 change of status again in 2006 but not for family. Their H4 from 2005 was valid till 2008.
    But Now while I am changing my job, New attorney says that my family is out of status and because we did not file H4 for them again.

    What is the alternative to bring them in status. They have vaild i-94 from L2 which is valid till 2009 and they have approved h4 from 2005 which is valid till 2008.
    Now my new employer have started my H1 transfer. I am thinking that for my family I will apply H4 change of status once my approval comes. Is that Okay or there is any other alternative to bring them in the status.

    My family can not travel to India for H4 stamping till the end of this year. My wife will be delivering a baby in October. Will there be any problem for my new born baby for the passport?

    Please advise.

    What do I make out of this? U think once assigned to an officer thgs shud start moving? Or...even after getting assigned to an IO thgs can go bad? Has any thing of that sort also happened? Just curious so I can be prepared...

    I don't think so. The only thing that could have happened is that a RFE on any further information. But becuase of the pre-adjudication the chances of an RFE is very very minimal, I will say down to ZERO.

    So be happy and just keep your fingers crossed to hear the good news!!!

    Both Addresses will be printed on the passport. One for current address in USA and other for Indian Permanent address.

    Application form is asking for address to be printed and other address. I am planning to keep my India address (my place) on my passport. I use my passport as a address proof in Inida. It means i need to fill it in address to be printed coulum.
    What is the other address. Are they going to print this in passport as well. If they are going to print this in passport, can i give my India address here as well? Is it mandatory to give one US address (other address)? Please help me. I am trying to renew the passport and would like to keep my existing India address.

    If you read closely, it appears like the 290,000 immigrant visas would be true for years from now on and for years 2001-2005 (the diffrence between current limit and this section). If that's the case and if that becomes a law, there is possibility there will be no backlog after that for some time...short time probably. Please correct me if I am wrongly reading this section. But for me, it appears it applies retroactively and will add the diffrence (150k a year) between years 2001-2005. If my calculation and understanding is correct, once this act becomes a law, the first year there would be 290k + 600k from years 2001-2005 ......I am not sure if my understanding is correct. I prey it is..

    I don' think there is a point which says the visas from 2001-2005 will we
    290K. From this fiscal year it will be 290K.

    1) The total number of visa available that were not used last year
    2) the total number of visa available that we not used from 2001-2005

    From 2001-2006 the total was 140K

    140 / 4 categories = 35000K for each(India-china-mexico-other). Now we do not know how many were unused from 2001-2006.

    From what I understand, I do understand the country limits, and my guess is
    There is no country limits, but only EB type limits.

    If I am correct the dates of Each should move at least 2-2.5 years from now.

    I believe people who need I-485 filling option without priority date should hope to get this too. STEM section has more support to be passed because it was never an issue in any of the houses.

    he has applied for transfer to the old H1(2005 one for which stamping was no done)with i-94 attached

    So I read that the amendment for recapture has been removed from the funding bill. Guess we are back to the start again? This really makes me to start hate the fact that we are held as the hostage of illegals

    Is this true? where did you read this? would it be possible to post somemore information. Does this mean we stop calling or we still need to call? I just read this thread and started calling.

    It was a pleasure meeting and talking to you NeedHelp (dont want to use your real name here)..you are the sweetest ,warm kind hearted soul..The highlight for me was putting a face to all the names I had been in touch with on a daily basis..and ofcourse meeting my hero ..Aman ..

    I missed all the fun , I was running between work and kids..but still will cherish the memories from this grand event..

    Thanks to dh who let me do this and took care of the kids so well...they enjoyed the experience.

    Here is a scene I was in:

    Paskal(Puneet) is driving - Sumita is sitting on the passenger seat - we have no idea where we are going. It is 2:00a.m and we are REALLY hungry and tired...

    Sumita "I will give you directions from my Tom - Tom " I think she meant GPS.

    Puneet (after taking several wrong turns) "It is not a Tom - Tom"?

    Sumita- " whateverer it is , it gives me directions and I talk to it" (She was spending 4 hrs. driving each day with this TomTom ).

    Puneet - "ok, let's follow our friends".

    Sumita dials.

    Vandana(in the other car) - "Yeah you can follow us".

    Puneet - "well where are you guys"

    Vandana - "We are trying to figure out, I don't know how we got here - Let me consult my GPS"

    This is what happens when you are sleep deprived, food deprived - all the gadgets in the world cannot help you.

    we need members all over the country to meet or call local Senators and house Reps, about Employment Visa issues regularly and ask them to sponsor, support Bills for our concerns.
    This will ensure our voice is heard during meetings of each Chamber - Senate and Congress.
    Legal Immigration reform is the core goal of Immigration voice.
    This thread will discuss any bill introduced for Legal immigration, including employment and family based.

    The advantages being:

    1. CIR will not happen for the next 2 years with a republican house majority.
    2. This will be a much smaller Bill and a larger percentage of people would support this.
    3. We should distinguish ourselves from illegals for a path to the GC
    4. We have a big lobby ourselves, with hundreds of thousands pending, to up to 10 million GCs, citizens involved.
    5. We deserve preference for following all rules
    6. Illegals have a major point lacking - they did not use a H-2A visa and instead broke the law. Due to this there is popular discontent which may doom their legalization, or drag it on for many more years.
    7. Legals directly add benefit to the society and tax receipts. Many of us have paid close to 100K in 5 years to IRS. Taxation = fair representation. 5 years = 10 billion from all of us at least, if you assume only 100K immigrants.

    Please add points supporting or refuting this.

    I have no Ill-will towards illegals, this is just my opinion on what is better for the long term future of this country.
    I have the highest compassion for all the poor and needy of the world, but it is irrespective of race, religion, color.

    Can anyone please shed some light on the costs involved in a medical examination?

    It varies depending on the physician. I paid $475 for everything blood work to test immunizations + TB test + Physical exam. This is for one person.

    Same physician, my friend went with all medical records and she charged only $250 for doing physical and TB test.

    I got the report with in 3 days. Hope this helps. Good luck.

    Murthy's post sounds somewhat convincing because they heard it from Openheimer. On the other hand Gotcher whom I really respect was very confident in his forum that this category will keep on moving till July. So I have hope that we will see it move few months at least !!!     My wife and I went for the medical examination 1.5 years ago, when we thought we'll be eligible to file shortly. We still have those sealed envelopes. However, the time passed and I understand we need to undergo the exam again for our June filing, correct?

    The first time around my wife had a positive skin test (immunized in childhood) and negative Xray. Back then she was advised to never do the skin test again, as it'll always be positive. So, she'll need to go for an Xray this time. However, she is pregnant, and they don't Xray pregnant women... Is she an exempt then? There gotta be a provision for something like this, right?

    The Murray Amendment failed to make it through in the Senate Appropriations bill due to strong opposition from some senators for adding domestic issues with a war funding bill. The amendment wasn't defeated by vote, it was just that it was in the wrong place at the wrong time.

    The house bills HR 5882, 5921 and 6039 is gathering good momentum. Please call your own lawmakers, CHC members and the list of lawmakers which IV wants to call. Please call and ask them to co-sponsor these bipartisan bills

    We can make it happen.
