Dear all,
My employer filed H1B with extension of stay even though I was not physically present in USA on the day of filing.I was out of USA on June 15th due to personal reasons and they filed H1B on July 10th.
I had requested them not to file extension of stay since I was already out of USA.USCIS approved the petition with extension of stay(I-94 attached).I need to go for visa stamping now .Will this create any issues while stamping?
Please advice.

you may need to apply for h4 again since she used the EAD. Discussing with a good attorney who is knowledgable on this case is very important. Hope you have not used your EAD if got one. If used the issues can be worse as you may lose your h1B status as well.
Please update your case. I may also face such a sitaution . But not sure at this moment.

I am planning to use AC21 and notify USCIS about it. I have the labor job title, code and salary. The salary applied was in hourly rate of $46. So at the new permanent job, I have it as annual salary.
So how much would $46 be in annual salary or should I just have an hourly rate on my experience letter from my new employer.

My in-laws attended visitor visa interview at Hyderabad Consulate on 25th Feb. My mother-in-law (not working) got her visa (no questions asked) but father-in-law (an electrical engg manager, still working for central govt) was asked to fill out a questionnaire related to his professional experience and then given a white slip with a case number/email address and asked to email his resume/CV for further processing. He was told it would take 7 days to process his application.
I tried searching for similar cases on various forums and found some cases but couldn't find information on how long they took to approve the visa. So I was just wondering if anybody here has any further updates on such cases. Appreciate any feedback.

Offcourse they have entered A# time of the finger print I even gave them my EAD card along with ID which has my A# on it and entered it from there. A# is also on FP form which you have to fill out if you have A#. Hope that helps.

I got the receipt #s from back of the checks.

EB1 was applied under the Extraordinary ability. I also have a EB2-NIW I-140 cleared as well. Hope that answers your question.
As far as I know employer sponsorship is not required for EB-1 EA case; not sure why you had to file I-140 for this ...........

I have PD which is current (Jun 03 EB2 India), a RD which is current (Jun 05! yes VSC transfer to TSC in Apr 07). In the last week of Nov 07 got a simple RFE (medical RFE wherein the doc forgot to check one box), which was replied promptly and got confirmation from USCIS that they got the response.
Have been following up with USCIS (service request, POJ-TSC from April 7th). Got a soft LUD today (04/22/2008). does it mean anything ?

Did you write to the Ombudsman in form 7001 about 140 delay ( other thread ). I sent it yesterday. When did you file 140 at NSC ?

this is a standard reply when we enquire about a case.
I had enquired about 140 and got the same message. Then took an infopass and there the IO told there is nothing at 140 level and what I got is a standard reply .

Once you have two pay stubs , you can change the company. You can change even with a single pay stub but with two you are much safer.
Its a very debatable thing to discuss whether leaving so soon is good or not ..... wont go into it. You should always do what is best for you and your family. Everything else comes later.....

But both of my labor certifcates are from the same company. I read somewhere I-140 is for intending to employ me. How can they employ me in two categories one on EB3 and one on EB2.
Do you see any disadvantage if I file both from the same company.

And now for some good news.....The New York Times and the St. Petersburg Times reported two separate indidents of penalties and [prison sentences imposed on people who provided fraudulent immigration services to foreign nationals.
The NYT article (http://cityroom.blogs.nytimes.com/2010/03/01/3-million-judgment-in-immigration-fraud-case/?scp=2&sq=immigration&st=cse) describes how Miriam Mercedes Hernandez was ordered to pay $3 million in fines and restitution to her victims. Ms. Hernandez charged her victim up to $15,000 per person to help them get permanent residence or citizenship within eight month but never performed the services she claimed.
As the article states
Immigration fraud, often orchestrated by immigrants, has proliferated across the country, victimizing people desperate to gain legal residency or citizenship. Law enforcement officials say such schemes are particularly difficult to uncover and prosecute because many victims are in the country illegally and are hesitant to seek help from the authorities for fear of deportation.
Under state and federal law, only lawyers or representatives accredited by the Justice Department can represent people before the immigration authorities. Anyone providing immigration services must also comply with strict rules governing contracts and advertising.

Here we go again. When Obama's Democratic Party controlled the House and Senate, Congress failed to pass an immigration bill that would have provided a path to Residency and later Citizenship for some illegal immigrants who entered America as children. The DREAM Act died in the Senate in December due to a Republican filibuster.
With Republicans now controlling the House and holding a stronger minority in the Senate, the chances for any comprehensive immigration reform are considered non-existent.
Obama travels to Texas on Tuesday to make the case that his administration has worked hard to secure the border and the time has come for Congress to deal with the 10.8 million people already in the U.S. illegally.
He will also argue that those who care about this issue need to step up pressure on Congress to act, a point he has made privately in a string of meetings with business executives, evangelical leaders and Hispanic celebrities.
Many activists blame the White House for not making the issue more of a priority, and Tuesday's speech is an effort, in part, to shift attention to Republicans who are blocking action.
Many Republicans and some Democrats oppose the measures Mr. Obama favors that would create a path to citizenship for some people who entered the country illegally, saying it would reward law-breaking. Opponents also say not enough has been done to secure the border with Mexico. The White House says it has put more "boots on the ground" along the southwest border than ever before and has cracked down on employers who hire undocumented workers.
The administration has also deported a record number of illegal immigrants, a point that has angered Hispanic activists. Federal officials say deportations of illegal immigrants hit a record 392,000 in fiscal year 2010.
Hoping to push through the political stalemate, Mr. Obama has held private meetings to discuss immigration with political figures such as New York Mayor Michael Bloomberg, business leaders such as John Engler, president of the Business Roundtable; and religious leaders such as Leith Anderson, president of the National Association of Evangelicals.

Hi All,
I would like my parents and my younger brother who is in his engineering college 2 nd yr to visit me on visitor visa. My father is a government emoployee with more than a yr job left, my mother has retired last yr and my brother has still 2yrs left for his engineering.
1. Do you think they should raise any objection for my brother getting a tourist visa ?
2. Should my brother's case affect my parent's case as well? I think given my father is a govt employee in India, that should work in his favor? Any thoughts.
