I had a similar situation, and I had to change the employer and start all over again. However, your situation looks much better than mine. I was trying to find a lender to vouch for my employer, but that didn't happen. Your employer, on the other hand, has the lender. I believe you should be fine. The only area I'm not sure about is the period of time you didn't work for the health reason. This one I would consult about with a lawyer, since you are supposed to be employed while on H1b, or else you're out of status. There may be certain exceptions (like health-related issues) in the law.

I understand I can�t invoke AC21, but I was reading somewhere that � if you are changing your sponsored company and found same or similar job, then and then you need to file AC21, in my case my sponsored company is still same and ones I got GC, I will start working for them (like future employment).

Hello All,
My priority date becomes current as of 1'st Oct 2009... I had created an Service Request 2 weeks back to check with NSC if it has been preadjudicated or not...
Here is what i received as an email response to the Service Request today-
The status of this service request is:
The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact us by calling our customer service number provided below.
Questions:
1. What am i supposed to do now?
2. I remember seeing a Memo back in Feb 2008 which stated that 485 can be approved after waiting for 6 months for background check and not more than that.
Please let me know if anyone else has received a similar reply in Sep 2009... Any thoughts are highly appreciated...

Hello,
The cancellation of H1b takes 4-5 months and untill then nothing much to worry. You can join new company as soon as you file for H1b transfer.

I am getting my GC processed on a future employment offer. I already have my EB3 I-140 approved from NSC after A2P RFE, and my I-485 is pending since July 07. I plan to join my sponsoring employer shortly using my EAD, but my attorney told me that I have the optio to wait until I-485 approval. Hope this helps.

It looks to me like they made a mistake on the valid dates for the new EAD. That happened to me last year, I received my new EAD card and it was only good for 1.5 months.
I had to mail them the card and after a couple of calls and some headaches they sent me a new EAD card, this time valid for 2 years.

My Labor PD is Jan 2003, was approved on Sept 25th. Got it last week. It is very random process I guess. Can't tell how long you have to wait knowing so many people behind us got their approvals before us. Any inquiry didn't work. I just gave up and waited.

The battle for comprehensive immigration reform is going to be tough as Senate Republicans play politics with the critical immigration issue. The Senate passed its $44.3 billion fiscal 2010 Homeland Security appropriations measure 84-6 last week after three days of debate that differentiated the bill from its House companion on a handful of border security and immigration policies. Unfortunately Senate Republicans used the opportunity to add significant new provisions to the less controversial �extender provisions� including an extension to the Special Immigrant Nonminister Religious Worker Program and the Conrad Waiver Program for Physicians Serving in Underserved Areas. The Senate also included a provision promoted by AILA member Brent Renison to allow the foreign-born widows, children and parents of citizens who have died to retain their legal status to seek citizenship for two years after the death. This means if you filed 485 on July 2nd you should get a reject letter in the next 25 days unless they retrogress on this as well.
Where did you get "25" days from? Also, wouldn't it depend whether you sent it to NSC or TSC?

Hello,
I am Dec 02/EB3/India candidate. Currently using EAD/AP to work. No H1b visa.
My current project � SAP PI implementation requires me to travel to London / Ontario, Canada, on a weekly basis. This is going to be for few months at least. Employer is in US, major work place will be US, still working with original employer who filed GC; even residence is in US.
Has anyone travel more than once on AP?
Is that ok or there are risk factors?
Has anyone traveled on AP using car by road? How is experience compared to enter via airport?
Any help will be highly appreciated.
