WillGetGC2005 - here is my understanding of your case :-
 
You have PD of 2002. You filed 140 and it is already approved. Your 485 is also filed and its more than 2 years on it.
 
If the above is correct, you do not need to do PD transfer or start any new labor process either.
 
What you need to do is use AC21. When you change employers, make sure that the new employer/lawyer sends a note that you are using AC-21 to transfer your job and your new job is same as your old job. Your GC process will continue normally after that using the 485 you have filed.
 
The rule is if you have an approved I140 and your 485 is pending for more than six months, you can transfer employers using AC21. Your previous employer CANNOT revoke your I-140.
 
This is my understanding. If you have a new employer and have a job offer , just have a talk with the lawyer and things will clear up.

I would love to trade places with you if I could buddy, so just relax� on the other hand I sympathize with you, a 2001 PD seems so old to me. Being current is the boon, for you to have to stick with the same employer is the curse.

I am not sure about others, but since IV changed the look of this webpage, something is discouraging me from being as active as i was before. I gave myself sometime to adjust but that does not seem to happen.
 
Admins, please do some stats on hits, number of posts by users etc and see how the new look impacted the site activity?
 
Two points that I am not a fan of:
 
1) The front page top 10 forum items still need to be improved. We need complete text display (wrapped if long), the tooltip is not working. I do not want to mouse over every thread to read it completely.
 
2) User images (i know i have one myself) are making the webpage cluttered and distracting from the real content.

For my canada GC i calibrated my camera, took pictures of 3 of us with my 3 mega-pixel camera, and printed at walmart on 4x6 then cut 27 X 27mm, and it worked, i have canada GC. just make sure front face, white b/g, enough brightness. i would not risk it for my US GC though.

Hello All,
 
Had a qstn. Is it good enough to take just the offer letter from the current co and latest paystub to the consulate in Chennai to stamp H1B ? Its for a friend of mine and he is a first time H1B applicant. Problem is if he puts in a req to the HR for exp letter they will ask him a reason and the reason will be printed on top of the letter, and obviously he cant ask for a letter to US consulate for H1B since they will come to know he has intentions to leave.
 
I am sure a lot of people would have been in similar situation. Did not find any other thread that discussed this issue, so in case there is one please point it out to me otherwise any suggestions would eb welcome.

Generally STEM - Science, Technology, Engineering and Math all fall under Science/Engineering colleges. Anthing out of this college including MBA, MA, Accountancy, Marketing etc are not included in STEM.
 
I am wondering if social science degrees would qualify as STEM. Some examples are -
 
MS in Psychology
MS in Administration and Criminal Justice
MA in History
MA in Political Science
MS in International Relations
What would be considered STEM

My friend received a letter from USCIS in response to his phone call asking then why they have not taken a decision inspite of 60 days expired after responding RFE. This is what the letter mentions.
 
The status of this service request is:
 
Your application is pending the availability of 3rd preference employment based Visas. Currently there are none available. You are invited to visit the Department of State website where you may keep abreast of any developments regarding this classification of Visa.
 
What does this mean ? Now, he don't have to worry about any future RFE/Denials ? Can he make his future plans assuming he will get his GC one day ?? His PD is 2001.

Do you have your 140 receipt and please post the status if the status is updated to denied/revoked/withdrawn.

The Senate and the house may be passing the tax refund bill soon (due to slowing economy). There is lot of pressure on the government to act soon.
 
Can we get them to attach atleast one of our provisions with these bills - the most important and non controversial being recapture of unused visa numbers.
 
Just a suggestion................I know there is no dearth of suggestions.
 
We should definitely try (in addition to writing letters).
 
Can we get some more information about this bill? Who are the key players supporting/pushing it, who/how do we contact to try and push some of these reforms?

Take infopass, go with your welcome notice, get 551 stamp - it will allow you to travel until you get the physical card. Usually, 551 stamp is valid 1 year from the date of stamping.

my lawyer missed the 2nd july deadline even when he had all the papers. Now i am asking him to meet 30th july deadline he is not responding . what are the papers needed to file I485. Can I file it without lawyers help? He does have my immunization papers

yup your renewed 797 has not been entered in their PIMS database, that is why the delay , you should be all set in 1-2 weeks time.

I will be thankful to you if i can get the responses from some folks who have gone through the situation like mine.
 
Here is the summary of my case -
 
1) Came to US in 2004 on F1 visa.
2) Got the job in 2006. Company A applied for H1B in 2007. Got H1B visa stamped on passport valid from September 2007 to September 2010.
 
3) Was laid off on 16th Novmeber 2007.
 
4) Company B applied for H1B petition on 21st December 2007 using regular processing. No pay check from company B.
 
5) Company C applied for H1B petition in March 2008 using premium processing. Comapny C applied based on A and not based on B.
 
6) Company C's petition got approved but with I 797 B. No I - 94 attached. Attorney asked me to leave the country and come back with a new I 94 as i have an almost brand new visa. I did so. And started working with Company C. Meanwhile, company B's petition was approved in May 2008 without Adjustment of Status (means no I 94 attached only I 797 B)
 
7) Worked with company C from April 2008 to September 2008. Although, no pay check from 16th November 2007 to 1 April 2008 because company B did not provide any.
 
8) Got the job with company D. Company D applied for H1B petition and it was approved with I 94 attached ( means I 797A).
 
Now 2010 is coming and my visa will expire in September 2010.
 
I want to go to India to get the H1B stamp on my passport with the current employer's I 797 (which is employer D).
 
I do not have any documentation from Company B except receipt number for H1B petition. I do not have any pay check from company B.
 
I have paycheck from 1st April 2008 to 31 September 2008 from Company C and 1st October 2008 to till date from Company D.
 
Will i face problem during visa interview?
