Can some one reply to my post please. My question is regarding EAD only. Once I apply for EAD and go to India what happens
1. If I am not there while it approved? Can my frnd send me the EAD to India?
2. if I get called for finger printing for EAD and if dont go for it? Will my AOS will be treated as abandoned?

You can only stay in the US if you can change to another lawful status. As a UK citizen, the only work-authorized status that might be available, though difficult, is O-1 for extraordinary ability aliens. If the company won't start the permanent residence process for you, unfortunately you have very limited options.

Iam on H1 and my wife and 2 kids are on H4. we have been here for 3.5 yrs now. My petition has to be extended next year. My employer is delaying my GC process (not applied yet).
My Wife's brother who is a citizen is planning to apply for I-130 for my wife (not sure if it can be applied for me and kids as well, that is a different question).
However my main questions are:
- if he applies for I-130 for my wife, will it affect her H4 status or will I-130 application be affected due to her H4 status here?
- Will we have a problem when we apply for the petition renewal next year?
- Also will it affect the employer based Green card application (whenever int he future my employer applies for me)?

NYGal if you go to immigration.com then go to forums then Labor certification then Backlog centers the updated site is there in the forums under the title similar to my thread.

Hi Guys:
My wife is out of country from October 2010. She was working on H1B. After birth of our son, she went to India for 6 month vacation. Will there be any issues if she re-enters US using H1B as she is having a job to continue with her employer.
What are all the documents I need to take.
Please advice.

Hi,
I am applying for Citizenship after completing 4 years and 9 months as a Permanent Resident in US.
Can any one please let me know as what is the processing time to get the Citizenship after I apply?
Also I have planned to move to a different State after I apply for Citizenship.
Please let me know whether it fine to move to a different address after applying for Citizenship? Else is this move not advisable?
Does this address change delay my Citizenship processing time?
Appreciate your guidance.

Hi All,
I just called USCIS using the POJ method to check on my I485 status which is current for June (EB2 India PD is 3/20/04).
IO said a visa needs to be ordered for the file and it will be done in the next quarter i.e, July 08.She also said the file will not be assigned to the IO unless the visa is ordered??
Does this mean that all the visas for EB2 have been used for this quarter? Also, not sure why the file wont be worked on until the visa is ordered...which contradicts the pre-adjudication theory.

I have a simple question. The total number of I-485s pending as per USCIS is around 220,000. If we have 130000 EB visas every year, will the backlog be cleared in just 2 years?

I have 2 clarifications
a)Anyone has a clue on what an Employment Development department letter means? Is this the same as the 45 day acknowledgement letter from DOL?
b) In the absence of an 45 day acknowledgment letter from DOL, how else can we get a confirmation that our case has been filed with DOL. As per our company Attorney DOL is not issuing the 45 day letter. Can I ask for a screen shot. I saw some threads on that.. How do I ask for a screen shot of my case ? Any specific procedure? What is the response time for receving the screen shot? Do you need to specify a reason for asking screen shot?
Anyone who has done this ,can you please help

(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....
