Hello All,
Being on H-1 never allowed you to get promoted unless the employer did all the necessary paperwork with USCIS/DOL. EAD being work authorization not limited to current employer, can EAD mean a little more freedom to waiting-for-GC H-1Bs in terms of being able to get promoted within the organization, get different job titles, etc ?
Also, I have 140 approved and H-1B ext was granted for 3 years (till 2010). Does it make any sense to apply for EAD alongwith 485 ? If EAD gives the career advancement opportunities, can I apply for it but keep using my H-1B to re-enter US till 2010 if needed ?
Thanks

I am on US since Apr 2003 on L1B and it expires on Jan 25 2008
Last week my employer applied for L1A and it got approved. Approval notice says the new L1A visa is valid from Jan 26 2008 to Jan 26 2010(2 years)
I am planning to travel to india on vacation at dec 2007 and come back to US on Jan 1 2008
1) If I travel back to US on Jan 1 2008 without stamping L1A on passport, will the port of entry officer give I94 till Jan 26 2010 if I show the approved L1A I797 petition?
2) If I stamp L1A from India, when stamping the new L1A, I assume they will cancel my current L1B and stamp L1A which is valid only from Jan 26 2008. Am I correct? Then I will not be able to travel on Jan 1st 2008 since I dont have a valid visa stamped on passport at that time!
What to do ....Please help!

My wife is on F1 and has applied for AP.
We have been waiting forever for AP(nothing new, right?).
Since her F1 is invalidated for the purpose of re-entry, can she apply for H4? and use that for re-entry?
If you have done this change to H4 recently, I will very much appreciate your reply.
Thanks!

Hello,
I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?
Thanks to all in advance.

My situation is tricky here. I would really appreciate any inputs.
My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.
Please guide me through the process and any scenarios. Thank you in advance.

U.S. Department of Labor (DOL) H-1B audits are just another unfortunate by-product of our uncertain economic times. Recent experience shows that DOL will not only request to see an employers H-1B Public Access Files relating to a specified period of time, but will also request other company records to determine whether an H-1B worker was paid the required wage (i.e, the higher of the applicable prevailing wage or the actual wage paid to similarly employed U.S. workers) at all relevant times. It is critical, therefore, that employers not only insure that their H-1B Public Access Files are in order, but...

I have a peculiar situation where my wife wants to apply for H1 and work after being on H4 for the last 3 years . My son who is currently on H4 wants to convert to F1 to pursue his studies . My doubt is whether I can still include them in my GC application at 485 stage whenever it happens although they were in H4 when the GC Process started.
Any suggestion / advice is highly appreciated.
Thanks,
Pandi

Company A applied for labor(EB2) in Dec2006. It was approved.
My I140 was filed in March 2007 and approved on Jan 10 2008.
I did not file for I485 in July 2007.
I had changed companies in April 2007.Presenly I am on Company B payroll.
Now, If I move back to Company A, would I be able to apply for my I485 when the date opens.
The online status for I140 says, Approved.
I am in good terms with both the employers.
If I move to company A; at the time of applying I485, do I need to have paystubs from Company A?
Please help. Thanks

I am really unclear about the whole process of the i-90. My situation as whole is unclear to
me. I gave a call to the USCIS to find out my status since i recieved my welcome letter by mail only to find out that my green card has been mailed back by usps and labeled "undeliverable". I dont know exactly what happen but i already started an i-90. If i wanted to travel outside the US, what would i need? I have seen people suggesting getting an i-551 stamp. But those people were renewing their green card. Would my situation be different as I actually never held a green card. Would they still stamp
my passport so i can travel out of the country or would there be other ways to?

Hello,
I filed 485 and also obtained EAD and AP. My wife has her own H1b through her employer, but used the AP from my 485 application once to enter the U.S., so right now her I94 shows an AOS status without an expiration date. Now her employer just filed H1b extension for her and the case is still pending.
My question is:
1) Can she travel internationally while her H1b extension case is pending and come back using AP? I was told this could void her H1b extension application according to the last action rule, is that true?
2) If 1) will be a problem, could it help if she stays aboard until her H1b extension gets approved and have the document mailed to her before she comes back?
Thanks a lot

Hi
Would really appreciate if some one can answer this question.
Is it possible to movie from H1B to EDA (valid unitl Oct 2010), work part time on EAD to complete Master's degree and then move back to the same employer to continuing working full time on H1B?
(assuming current employer is willing to allow going part time)
Thanks

Hi Guys,
I am masters student from USA. Last june i graduated masters and started my OPT. My OPT ends 2009 feb. In this April 2008, i have applied for H1 and just few weeks back i came to know that my H1b got approved. Its validity date will be from October 2008. I want to go to visa stamping in canada or mexico in july or august or september ie before october(h1b valid date) only. Is this possible.
Will i get any problems while returning back to USA from canada as my h1 validity date is from october. Is it possible that even if i get visa stamped, can i go to india in september like that as we are having some family function over there and planning in advance. It would be great if you can clarify my doubts.
Thanks in advance.

Good that the GOP nominee for the Senate in California is taking a centrist position, but its annoying to hear about being opposed to amnesty. So is just about everyone who favors comprehensive immigration reform. The question is not whether you're against legalizing people and not punishing their behavior. None of the versions of immigration reform introduced in the last five years do that. All contain varying degrees of punishment - paying fines, going to the back of the line behind current green card applicants, paying back taxes, passing English exams, doing community service, etc. etc. Is Fiorina against any...
