I know ability to pay issue is analyzed at I-140 stage, but the ability to pay the proffered wage begins at priority date and ends at the time I-485 is approved.
After I-140 approval, could be ability to pay examined again?
I read that someone went to an interview and was asked for sponsor company's taxes in order to check if the company still had ability to pay the salary.
Would be possible an RFE asking for updated financials of the company?

I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.
I want to use AP again, is there any problem.
Has anybody done that.

Hi, I have/had valid I-94 all the time. Recently I renewed my passport in US. But I renewed it 3 months after expiry of old one. I heard from friends that, you need to have valid passport for the entire period of H1B petition validity. Wondering, If am in trouble for not renewing my passport before it expired. Please give your opinions.

Hi,
I applied for EAD renewal at NSC on 07/03/08 and today 08/06/2008, the status shows card production ordered. I applied for my wife along with me and her status shows still received.
Does the dependent (spouse) EAD in general get approved a few days after the primary applicants EAD is approved? I am not really using the EAD, its my wife who is using it, and thats the concern.

hey everyone I was trying to download the swift 3d because a pparently it sweems like a cool one but the download trial wasn't accuriable anyway I looged into the net store and checked the full program, it costs about 159$ so I guess I want to download the trial first to give it a try before spending that much amount of money so if any of you know where to donwlaod it just plz post me a message with the title"FOund what you wanted" on your subjectt space.=)

Since ur I-485 is approved which means you will get Green card in abt week to 10 days they have denied EAD. So there is nothing to be concerned.

Hi,
My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.
In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?
I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

Do not do this - please stop playing around with USCIS rules. There are sometimes unfortunate circumstances where folks lose status (e.g., OPT -> H1b) or are kept in dark about their H1B status by employers but for folks who break the law in a way that you are suggesting, I believe they should be punished.
