The annual Consumer Electronics Show kicks off this week in Las Vegas. This is the gadget wonderland I've attended for the last several years. Due to my father's illness, I decided to skip this year's show. But I'm avidly watching online for announcements of the year's best new innovations. Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. I am with H-1 visa. Recently, I help another company finish one project, then I received a stipend of $8K. They will send me 1099 misc form for tax purpose. Does it affect my H-1 status and green card application? Thank you.

Do you have EAD? If not, you may be in trouble as H1 does not allow you to do a side job.

I am in the process of applying for the green card but as the labor department was delayed to send the paperwork by status became out of status, my lawyer suggested me to go back to my country apply for H1B visa and come back. That is why I want to apply for H1B visa . My lawyer tells me that there is no way I can get an approval if my company doesnt show tax return documents for the last 2 years. Is it true or there is another way or documentation which could be used in order to apply for the visa? My boss doesnt want to show the tax returns but accepts to show a bank account and different type of paperwork such as franchise agreements or certificates.

Can you please let me know if my lawyer suggests me the righ way if not which woudl be the best way to continue my green card process and get a result as soon as possible.

Hi,

My H-1 was approved in 2004 by the Texas Service Center. According to the instructions for I-539, for change of status to H4, it says:

"If The principal’s petition and change of status request are approved, mail form I-539 to the same Service Center that approved the principal’s I-129 and change of status or extension application. Include a copy of the principal’s approval notice."

This Skil bill in HR development looks very exciting....may be this will be the our savior bill. Now senate and house both has similar bills and based upon the trend, it looks there is not much resistance to this new bill.

I hope with in few weeks we, the retrogression sufferers will be out of the dodge.

what is the best bet after I-140 denied?
I mean does it make any difference far as 485/EAD if the employer does appeal or MTR?
I mean is there a possibility of keeping the 485 and EAD alive after I-140 denied if employer appeal or Motion to Reopen?
