All,
My lawyer received an RFE on my EB3/RIR labor cert on priority date 01/26/04In Feb sometime and responded back exactly on the last day (03/01/07) it was due. I have not heard anything back from DBEC since then. Anyone here have any idea how much time they take to approve the labor after RFE is responded back, if at all they do approve it? I know couple of my friends in CA who got their labor approved within a month after their RFE was responded back. My labor was filed from WI.
Please post your experiences if anyone experienced this before. The RFE was about company's financial document. I am not worried about the financial status of the company as it is doing pretty good from last 3-4 years consistently.
any info on this issue will be appreciated.
Thanks!

You are already counted in the quota. So it is just transfer. But for transfer need recent paystubs. Consult a lawyer how to handle this. Definitly you no need to wait for April 1 st quota for new H1B.

We still don't have the official summary of the Senate comprehensive immigration reform bill, but Senator Charles Schumer, the chair of the Senate Immigration Subcommittee and Senator Lindsey Graham (R-SC) have written a joint op-ed piece that will appear in tomorrow morning's Washington Post that describes the major provisions of the CIR bill they will shortly introduce in the Senate. The bill will look similar to previous bills, but we now learn that it will have some new features. They include the introduction of the controversial new national identification card (a biometric social security card). The legalization program will now...

Hello,
My firm is about to start greencard processcing for me and this is the first time that they are undergoing this process. They are searching for letter templates which decribes the employee eligibility and responsibilies in the firm and why they want to recommend greencard for this perticular employee. If anybody can upload such kind of templates/documents, that would be of greater help.
Thanks.

Unpopular Congress enduring tough times (http://www.reuters.com/article/topNews/idUSN0923700020070710) By Steve Holland Reuters, Jul 10, 2007
WASHINGTON (Reuters) - These are tough times for the Democratic-led U.S. Congress, where partisan battles have led to little progress on big issues and have made lawmakers collectively less popular than President George W. Bush.
Congress, typically never all that popular to begin with, starts the second half of 2007 with an anemic job approval rating of about 25 percent, down from 43 percent in January, with one Gallup poll ranking lawmakers at 14 percent.
Experts attribute the woeful rankings to an inability to force a change in direction in Iraq, the priority Democrats campaigned on to gain power in both the House of Representatives and the Senate in last November's elections.
But that is not all. There has been little to show on other priorities, including a change in Social Security and other entitlement programs that will run out of money in the years ahead, in addition to overhauling a health care system that has left millions uninsured and a broken immigration policy.
"I think Americans were expecting a great deal from the new Congress, and Congress has always been held in low esteem, but Congress really hasn't delivered on what it promised, especially on Iraq," said Paul Light, a congressional expert who is a professor at New York University.
Democrats in charge of Congress insist they have made progress on several issues, like increasing the minimum hourly wage and getting money for victims of the 2005 Katrina hurricane. They blame the Republican minority for a failure on others such as immigration, greater energy independence, and on negotiation of lower-priced drugs for Medicare.
"I'm not really much for polls," said Senate Majority Leader Harry Reid of Nevada. "We're going to continue doing what we think is the right thing for the American public in spite of a White House and the Republicans who are stalling every step of the way."
IRAQ DEBATE
Democrats drew a line in the sand over Iraq in the spring, using a $100 billion war spending bill to try to force Bush to accept a troop withdrawal date.
The effort failed miserably, with Bush finally getting what he wanted with no strings attached, and the White House saw the fractious debate as taking time away from work on other priorities.
"They've proven that they're not capable of taking on big issues," an administration official said.
Democrats beg to differ, pointing out that under their stewardship the Congress has resumed its traditional watchdog role over an administration they feel got off scot-free under Republican leadership.
"I would say in the first six months, gauging how things operate here from the majority, that we had some important work to do," said House Speaker Nancy Pelosi of California. "We had to drain the swamp. We had to create the oversight."
With American patience running thin over the Iraq war and casualties rising, Democrats may eventually force a change in direction in the unpopular war, an effort being renewed this week on Capitol Hill.
The Iraq situation has so infuriated the Democratic left that Cindy Sheehan, the California liberal who began a long protest against Bush after her soldier son Casey was killed in Iraq, is talking about running against Pelosi in 2008.
"I think the decline in support (for Congress) since the Democrats took over reflects in part the unhappiness of the base in the inability of Democrats to immediately stop the war in Iraq," said Thomas Mann, a congressional expert at the Brookings Institution.
The analysts say Congress' low poll numbers also reflect an altogether negative mood among Americans who are tired of the war, fed up with rising gasoline prices and worried about their jobs in a changing economy.
But how all this plays out in the 2008 election is hard to say. Incumbent lawmakers, while collectively held in low esteem, rarely fail to win re-election.

The Diversity Immigrant Visa program is a United States congressionally-mandated lottery program for receiving a United States Permanent Resident Card. It is also known as the Green Card Lottery. The lottery is administered on an annual basis by the Department of State and conducted under the terms of Section 203(c) of the Immigration and Nationality Act (INA). Section 131 of the Immigration Act of 1990 (Pub. L. 101-649) amended INA 203 to provide for a new class of immigrants known as "diversity immigrants" (DV immigrants). The Act makes available 50,000[1] permanent resident visas annually to persons from countries with low rates of immigration to the United States.

I've written time and again on the mission amnesia that afflicts federal immigration agencies. For students of bureaucratic behavior in the immigration ecosystem, another key lesson on forgetfulness can be learned in a teachable moment offered at taxpayer expense if we examine federal decisions in the pre-spill era before the offshore and onshore catastrophe in the Gulf of Mexico. To be sure, most of the blame for the failure of government to have refused permission to deploy the Deepwater Horizon rig goes, deservedly, to the Minerals Management Service (since rebranded as the Bureau of Ocean Energy Management, Regulation and Enforcement)....

Good. Members of Congress who think Latino voters aren't paying attention and they can vote anti-immigrant to keep Tea Party activists happy may want to rethink that strategy. In related news. America's Voice has released poll data showing Latino voters are not energized and aren't planning on coming out in big numbers in November unless they seem some positive action on immigration reform. From America's Voice: Latino Decisions researcher and Stanford University professor Dr. Gary Segura highlighted and analyzed the findings: Among all the key constituents in the 2008 Obama victory, Latino voters appear to be among the least enthusiastic...

I am not sure what is so important in this to answer.
As long as thay had sent the finger prints to you, you should be OK. There is no particular pattern in which they send the EAD cards. So, no body can answer your question about when will you get the EAD. Just pray and watch. If it is more than 90 days since you have applied for your EAD, then you may contact your local office to expedite the process.

It should not be a problem. Our GC's were approved when we were overseas and we came in using AP's.
Try to bring print outs of approval from USCIS website. If you have that, they will admit you as a PR. I tried explaining but they didn't listen and used the AP. If you have a printout they willl stamp your passport as a PR and let you in.

Is it possible to obtain a Greencard from L1B status? If yes, how long does this process typically take? My understanding is it is possible and definitely easier/shorter than being on H1?

A new poll from Bendixen and Associates of 800 Hispanic voters across the country reveals an electorate that is leaning Democratic, but one that is very concerned over how the Democrats are handling the immigration issue. The poll, commissioned by immigration advocacy group America's Voice, also shows Hispanic voters plan on voting in greater numbers than the general public in 2010.

I've been blogging about this for years, but the GOP still can't see that its tilt to being the anti-immigrant party is incredibly dangerous for its long-term prospects. The LA Times reports on this today. Some in the party suffer from the delusion that Latino voters don't care about immigration or, incredibly, actually agree with their positions. Polls show they overwhelmingly are concerned about the subject and they have been moving to the Democratic Party in droves over the last five years. When the recession is over (and its looking like 2011 will be a much improved year for the...

I am working for my current company since 2001 and started GC process in 2003(EB3 10/2003). So far my company paid all expenses towards my GC. I applied for 485 in 8/07.
Recently I got an offer as Manager. This is a much better position.
If I take that offer, will my current employer have the right to cancel I-140(since he incurred all the expenses towards my GC).
My company's current lawyer will definitely send the cancellation of G-28. in addition I am sure he will also intimate that I am not working with my current employer anymore. In addition I am also afraid he might cancel my I-140 with the intimation from my current employer. In this case, is it better for me to approach a new lawyer and send the AC21 letter attaching my new offer before my current lawyer/employer does their process.
Do i need any other letter from my new employer other than the Offer Letter to send the AC21 letter?
I did not tell my new employer that I am now on EAD (becoz he does not understand anything except GC or Citizenship). is it OK if I dont tell beofre I join them?
Thanks guys.
